We came upon an interesting article out of Baton Rouge, Louisiana regarding a lawsuit over a $62,000 engagement ring.
In Louisiana, much like Texas, an engagement ring is considered to be a conditional gift given in contemplation of marriage. However, the waters become muddy when the receiver of the ring contends that the ring was not in contemplation of marriage, but rather a gift of love and affection.
The situation is complicated by the fact that both the giver and receiver of the ring are attorneys. It will be interesting to see how the Judge in this matter handles the ring and whether or not it needs to be clear that the ring was given in contemplation of marriage by requiring that the giver asked the timeless question, “Will you marry me?”. We will just have to wait and see.
