Determination of Heirship
This is used to declare and identify heirs to an estate. A Determination of Heirship establishes a clear chain of title to estate assets when the estate does not qualify for a Small Estate Affidavit or Affidavit of Heirship.
It is filed with the court and no distribution can be made without the court signing the judgment declaring who the heirs are. Only the heirs named are entitled to receive a distribution of the estate. This judgment also specifically sets out the percentages each heir is entitled to from the estate.
