When someone dies without a will, an affidavit of heirship is used to establish a clear chain of title when the only asset of the estate is real property. It is filed in deed records in the county where the property is located. In order to use this process:
- The person (Decedent) must have died without a will;
- No petition has been filed for the appointment of a personal representative; and
- No formal administration is necessary.
