Subrogation

"Assuming the legal rights of someone or some entity whose debts or expenses have been paid."  Subrogation generally occurs when an insurance company has paid its insured, in accordance with the policy of insurance, and has assumed the legal rights the insured has against the third party that caused the injury or damages.  In other words, subrogation consists of forcing the responsible party to pay for the damages it caused.

Over the last 10 years, through trial or settlement, Shep Sands has represented at least 2.5 different insurance carriers and has recovered millions of dollars for those companies.  At the Law Offices of Joseph E. Ashmore, Jr. P.C., Shep continues to devote a significant portion of his practice to complex subrogation claims with a focus on third party worker’s compensation claims.  The additional areas of his subrogation practice include defective product claims as well as fire and water damage losses due to the negligence of service providers. The Firm’s subrogation practice is not limited to Texas.  With the assistance of local counsel, Shep has successfully litigated subrogation cases in Arkansas, California, Florida, Kentucky, Louisiana, Nevada, Oregon, and Washington.
