It was an innocent picture that kicked off an unfortunate chain of events for Michael Kuykendall. It was taken New Years Eve while out with a female friend.
"I have definitely lost some sleep this week", Kuykendall said.
Kuykendall was out with the same woman last weekend. When the night ended, she was drunk and decided to drive home herself despite Kuykendall's objections.
"I was trying to help her and prevent her from driving or hurting herself or hurting somebody", Kuykendall said.
When her friends didn't hear from her Saturday and Sunday, they remembered Kuykendall was the last person she was with. So someone pulled the picture from his Facebook page.
They sent it to Frank Cipriano who added the captions "missing" over the woman and "last seen with this guy" over Kuykendall and circulated it to his Facebook friends.
"I told them to repost it, and repost it, and repost it. You have this thing going out to 100 people within 15 minutes", Cipriano said.
And it got results.
"Within a matter of 15, 20 minutes, we had the guy's address, his home phone, his cell number. We had a place of business", Cipriano said.
Kuykendall says it made him look as if he had abducted the woman.
"It was something that was done prematurely", Kuykendall said.
As it turns out, the woman had gotten pulled over early Saturday morning for drunk driving and was sitting in jail. Kuykendall posted that on his page but somehow it was missed.
But there's not much Kuykendall can do. The picture was in a public forum and Cipriano was just trying to find the woman.
"Again he stuck to the facts and what he knew to be true I would think that intent is what would govern whether or not he should be held accountable", attorney Gary Ashmore said.
As soon as Cipriano learned the woman was in jail, he removed the post and is offering his apologies.
"I'm sorry. I hope everything clears out and I wish you well", he said.
As for Kuykendall, he says he's now more cautious of social media.
"This is a situation where basically your whole world can be torn apart as mine has been this week", he said.
